STATUS OF FEE HIKE CASE HEARING IN DELHI HIGH COURT:

The arbitrary Fee Hike by BMV case filed by some of the Parents Voice members was taken up in the Delhi High Court on 29-11-12. The DOE counsel did not file the Counter affidavit . The court ordered him to file the affidavit within two days. The rejoinder to be submitted within four weeks after that. The next date of hearing is 20-03-2013.

Status of Fee Hike Case Hearing

DOE paid the costs of Rs. 2500/- to the counsel of petitioners (parents). Earlier rejoinder was filed by the counsel of petitioners in the High court in response to the counter affidavit filed by the school. The court ordered the respondents to file affidavit within four weeks. The next date of hearing is 29-11-2012.

Status of Fee Hike case Hearing

The arbitrary Fee Hike by BMV case filed by some of the PV members was taken up in the Delhi High Court on 9-7-12. The DOE counsel did not submit the status report. Last opportunity is given to him by the court to submit the status report within two weeks failing which a cost of Rs. 2500/- will be imposed. Interim orders passed on 1-5-12 to continue till further orders. Next date of hearing is 5-10-12.

        In our view instead of responding to the facts, the counsels of DOE and school are using delay tactics. Such tactics can only delay the justice to some extent. We are confident that the truth will prevail sooner or later.

PLEASE ATTTEND THE ANNUAL GENERAL BODY MEETING ON 24.6.2012

PLEASE ATTEND PTA AGM AT 10.00 AM ON 24.6.2012 AT THE SCHOOL TO AVOID FORMATION OF A DUMMY AND PLIANT PTA. SUCH A PTA COULD MEAN SUBSTANDARD UNIFORMS AT HIGH COST, POOREST QUALITY TEXT BOOKS AT HIGH COST, INCREASE IN TRANSPORT FEE, AND HUGE FEE HIKE BETWEEN 20 AND 70% IN THE NEXT TWO YEARS; CONSEQUENTLY FURTHER SLIDE IN THE QUALITY OF EDUCATION. DURING THE PERIOD NOV 2011- JUNE 2012, THE SCHOOL ADMINISTRATION COULD HIKE ONLY 10% FEE( that too illegally) AND IMPLEMENT NONE OF THE ABOVE SO FAR DUE TO STRONG RESISTANCE PUT UP BY ONLY 3 OF THE 8 PARENT'S REPRESENTATIVES.

WHY PTA ELECTION DURING VACATION ?


The School Administration went ahead with tendering of school transport (having annual budget more than one crore) twice in absolute non-transparent manner, with dubious intentions. Two parent’s representatives (including the PTA Secretary) have demanded the SA in writing to follow due tender procedures, tabling all the transport fund related documents in the PTA Executive meeting, as the limited documents accessed by parents (through RTI) have shown suspicious accounts. The second tender procedure was to be completed  and earnest money of the unsuccessful bidders returned on 11.6.2012. But, this is not done till date. Besides other malicious intentions, the School Administration appears to be planning to get rid of this trap by bringing in a pliant PTA, as in the past, through  PTA Election during the summer vacation when most of the parents are out of station. This is being done in collusion with some PTA members.
PARENTS VOICE therefore asked through e-mail, these PTA representatives, to account for their action against the interest of parents, giving five days for their response. Since there was no response, notice for no-confidence motion against them (on 24.6.2012) has been served to the PTA Chairperson.

Secretary, BMV PTA replied the PV's letter

Dear members of Parents voice,

With reference to your letter dated 22/5/12 regarding PTA
election in BVB’s Mehta Vidyalaya, I want to clarify that I
am totally against the PTA election of only four parents representatives by draw during summer vacations. In the
PTA Exec. Meeting dated 8/5/12 on PTA election issue, I categorically wrote my dissent note in the minutes of the
meeting and emphasized on three points: 

1. Election should be held for all the eight parents
    representatives including office bearers ( Secretary,
    Vice chairperson and Jt. Secretary etc. ). 

2. Election must not be held during summer vacations but
    can be held on July 8, 2012 or later.


3. Election should be held by voting and not by draw. 


Ironically, minutes of this important meeting has not been circulated to members by the chairperson despite my several reminders.

Even before the PTA Exec. Meeting dated 8/5/12, I requested
to the Principal / Chairperson through my letter/email dated
6/5/12 that the election can now be held only after the summer vacations. The letter is attached herewith for your reference.

However, as per your letter I would further request the Principal
to hold the PTA elections democratically as per DOE circular
dated 12-4-2010.

Dear Madam,

Refer your mail dated 4th May, 2012 for PTA Exec. Meeting On 8-5-12 at 10.30 AM on PTA Election


issue. I would like to draw your attention to my mail dated 15-4-12 in response to your proposal for

PTA Exec. Meeting of dated 16-4-2012 in which I myself proposed you to include PTA Election point

 (as per DOE circular no. 1913 dated 12/4/2010) in the agenda of meeting dated 16-4-12. But the

 issue was not taken up even after my request. Now suddenly the School Administration (SA) want

 PTA election when the summer vacations are to begin from 13th of May, 2012. We may discuss the

 PTA election issue but the PTA election can now be held only in II/III week of July when the school

 will reopen or later. It will not be proper to hold PTA election during vacations because many parents

plan for out of station visits.


                    Further, again and again your office call PTA Exec. Meetings on a working day and during


working hours and on one or two agenda points when only SA find it fit to discuss without considering

of problems of Office going parents representatives. This despite the fact that I and several other

office going parents representatives have repetitively requested you that the PTA exec. Meeting should

 be held on a holiday (Saturday/Sunday) or before 9.30 AM on a working day but it seem that your office

 intentionally want to avoid office going parents representatives in PTA Exec. Meetings. Every school

 representative in the PTA is free and authorized to call PTA meeting without consulting even the

Secretary (parents representative). The information / notice to hold PTA Exec. Meeting on 8-5-12 was

given to parents representatives by as many as three school representatives of PTA but the proposal

of secretary whose job is to call meetings and to keep all the records of PTA is refused/ignored every

time for the same. SA has snatched all the responsibilities and duties of the PTA secretary (calling

meetings, preparing minutes of the meetings and keeping the records of the PTA etc. ) undermining

and flouting all the guidelines of DOE on PTA functioning in an unaided Pvt. School. It has been

observed that the school administration want to take all the major decisions concerning parents and

students only in the absence of secretary and few other office going parents representatives ( refer

PTA Exec. Meetings dated 11/1/12, 10/2/12 and 23/3/12) and then details of the decisions are refused

to provide to secretary even after request/demand for the same. Details of the terms and conditions

of the uniform contracts and rates approved in the PTA Exec. Meeting dated 10/2/12 have still not been

provided to me even after several requests. Even formal making over of the charge of PTA secretary

has not been done even after more than six months of PTA elections of 2011-12 and my request to

provide even photo copies of minutes of last three years PTA Exec. Meetings and PTA AGMs to secretary

(refer my email dated 11-12-2011) has not met yet. It seems that Bhavan’s Mehta Vidyalaya’s

administration does not require parents representatives in the PTA and it wants to continue to run PTA

in its own way and completely in a non-transparent manner and use PTA only as a rubber stamp

whenever required.


            You know that transport tendering process is on and the last date of tendering and tender


opening has been fixed by you as Friday, May 11, 2012 (working day) even after my request for

Saturday, May 12, 2012 ( holiday and PTM day). Therefore, I can not understand the urgency of

holding another PTA Exec. meeting on a working day (and only three days before tender opening

day) on PTA election issue which could have been taken in the PTA Exec. Meeting dated 16-4-2012.

Such actions of the SA certainly creates doubts on its intentions.


Further, as you know that for the last three weeks I along with some other parents representatives


are requesting you to arrange the route wise lists of students/teachers/staff availing school

transport facility,  their addresses and place of boarding/de-boarding the bus so that actual no. of

bus routes required and length of each route can be ascertained/ rearranged before the finalization

of tender process. I raised this issue in the PTA Exec. Meeting dated 16-4-12 and Smt. Shashi

Bhargava told then that route wise registers of such details are being maintained but the copies of

the same has still not been provided to me even after my several visits to school to get them.

Moreover, keeping such records is mandatory as per Supreme Court / DOE guidelines ( see

attachment ). It seem that there is something in the transport issue also that SA wants to hide from

the Secretary / parents representatives. Now, as the admission process has been completed, the

school should have complete and proper information of all the students and teachers availing

the school transport facility. Therefore, you are again requested to arrange to place the following

Documents related to transport issue in the forth coming PTA Exec. Meeting:



1. Route wise lists of students / teachers / staff with their addresses and place of boarding /

   
   de-boarding of school buses.


2. Income-expenditure statement of school transport for the year 2011-12.


3. Copy of minutes of PTA Exec meeting dated 7/11/2009 in which several vital decisions regarding

    transport issue ( hike of transport fee from Rs. 400 to Rs. 650 etc. ) were taken (as told to me by
   
    some Ex- PTA Executives).


4. Signed copies of inspection reports (for the year 2011-12) of 16 routes on which buses of M/s

    
    Prince  Travels ply.


5. List of major transport related complaints made by parents/teachers against Pvt. Transporter


     and details of penalties imposed on Pvt. Transporter during 2011-12.

6. Copy of terms and conditions of present transport contract with the Pvt. Contractor (M/s Prince Travels).



                               I am confident that I along with some other PTA representatives will work on bus routes

rearrangement and will certainly balance the bus routes on no. of persons using buses and no. of

kilometers run on different bus routes.


Further, I propose you to hold PTA Exec. Meeting on Saturday, May 12, 2012 after PTM

instead on 8-5-2012 at 10-30 AM to discuss about the PTA Election issue.

The case against Fee Hike by Bhavan's Mehta Vidyalaya was taken up on May 1, 2012 in the Delhi High Court. The next date of hearing is 9-7-2012. DOE and BMV have been ordered to file affidavits on the status of review of the school fee within 15 days. The court has also directed the school not to use coercive steps to recover the enhanced development fee from the students till 09 July, 2012.

WRIT PETION IN THE DELHI COURT AGAINST ARBITRARY AND ILLEGAL FEE HIKE BY BMV

Dear parents,

   The Bhavan’s Mehta Vidyalaya, K. G. Marg ND,  has once again hiked the Tuition Fee and other charges in the current session 2012-13 despite the strong opposition from parents. Surprisingly, the Annual charges and the illegal Development Fund has been asked to deposit in the April itself while the last year these were equally divided into all the four quarters.

 It is for the information to members that a writ petition on the illegal   Fees issues filed by some of members of PARENTS VOICE  in the Delhi High Court has already been admitted and the  next date of hearing is 23-4-2012.  In the petition we have demanded the following:

1.     Stay on 10% T. Fee hike in the current session (2012-13),
2.     Stay on collection of illegal development fund in 2012-13 as the school already have more than four crore rupees of surplus Development Fund,
3.     Return with interest the 30% Fee hike implemented in 2011-12,
4.     Return with interest the illegal Arrear of Rs. 4800/- in Year
      2010-11,
5.     Return with interest the illegal Development Fund collected during last three years, etc.

    Members can themselves analyze the arbitrary and illegal collection of fees and other charges by the BMV from the Annexure attached herewith as A and B. Actually there should be a reduction in T. Fee by more than 20% this year as explained in the Anneure. These two Annexure are  most recent complaints made  to Department of Education (DOE) against arbitrary and illegal collection of fees/charges and  flouting of all the guidelines of DOE by BMV.

WE  EXPECT DOE WILL ACT IN FAVOR  
             OF  PARENTS VERY SOON.

Contribute your MORAL suppoort in the struggle against commerciallization of Education in the School. We parents are hopefull that we will be able to re-establish the Lost GLORY of OUR SCHOOL.

ANNEXURE "A":  COMPLAINT DATED 18-1-12 TO DOE

Sub:  Complaint against Fee hike in 2011-12 and Gross financial embezzlement and exploitation of parents by  Bharatiya Vidya Bhavan’s Mehta Vidyalaya(BVBMV)  (2026130),  New Delhi

           Parents, wards and teachers in BMV have been haplessly at the receiving end for the last few years. Commercialization and profiteering in violation of almost all guidelines/rulings of DOE, Supreme Court and Delhi High Court, have been relentlessly going on to the detriments of all stake holders except the School Management. Parent’s, both individual and collective, complaints to DOE and CBSE during the last almost two years did not bring any tangible results so far.
2.       DOE was found to be sleeping over these complaints, which resulted in unbridled corruption and brutal exploitation of parents, wards and teachers. PTA which is supposed to be an effective bridge between stake holders of education and is required to be consulted and approval taken from, for many vital issues relating to academic and other activities of the school, as per DOE Guidelines,  has  been reduced to a farce by the School Management(SM) by manipulating the PTA Elections, handpicking the office bearers of PTA, not signing the minutes of PTA General Body and Executive meetings, if not always prepared in ways best suiting to the commercial interests of the SM and not implementing any of the decisions taken in the PTA Executive meetings for years. Further, SM has always been splitting the PTA, apparently by manipulations and corruption. (PTA is practically members of Parents representatives, as hapless teachers always sign on dotted lines, as dictated by the SM). Vulnerable Parents representatives for obvious reasons fall victim to this culture of chicanery and sycophancy, to the detriments of all stake holders in the school except the SM.
3.          Emboldened by the tacit support BMV is receiving from DOE in various forms- not scrutinizing the annual returns submitted by the school, not inspecting the school, not even insisting for the annual returns whenever failed to submit, not attending to the complaints received from parents about the brutal exploitation of parents by the SMC, colluding with the SM in manipulating PTA Elections, PTA functioning, SMC meetings etc.
4.    The SA with impunity, again split this years PTA (Parents representatives) into two.  Two- three PTA representatives in collusion with SM and with dubious intentions have been pressing for sub committees formation within PTA for almost last  two months. PTA sub committees have been seen to be misused by the SM a number of times in the past (they have no mandate and are ostensibly instituted by the SM to bypass PTA for obtaining financial approvals in order to meet its various commercial interests).  The principal held a selective meeting of five out of the eight parent’s representatives on 06.1.2012 without intimation to PTA Secretary and Vice chairman and decided to call an emergency PTA Executive meeting on  three issues 1. Uniform, 2. Transport and 3. Formation of subcommittees to be held on 11.1.2012, with ulterior motives.  This was ignoring PTA Secretary’s action for full fledged PTA Executive Meeting   to be held on 14 or 15 January 2012 on a number of issues including transport and uniform.  In this connection you are requested to look into the communications between the present PTA Secretary and Vice Chairperson with the Chairperson (Principal) whose copies are attached as  Annexure A (13 pages) and same was sent to DDE(C/ND) by e-mail.
5.    The school has been imparting perverted education to the children for the last several years. Things came to light only last year when it was noticed that substandard costly and private published Text books with hundreds of mistakes were imposed on the children and parents who remained option less despite prior communication by parents about the same in previous year. . This was totally undermining the NCF and national policy on education. NCERT curriculum was not even completed in many classes during academic year 2010-11.
6.  A no. of complaints by individual/groups were made to DOE/DDE(C/ND) during last year 2010-11 against the fee hike but no action was taken. Inaction by DOE last year encouraged the BMV SM  to unilaterally hike the fee by 30% in 2011-12.
 7.   In the AGM held on 16.10.2011, the aggrieved parents raised their concerns and asked the SM to justify the  30 % fee hike with documental support. Parents asked to account for the huge money collected from parents during the last 10 years in the form of Development Fund and Annual Fee; and why such a huge corpus fund was not utilized instead of resorting to a huge and unprecedented fee hike of 30 % as per DOE Guidelines. But, SM failed to answer convincingly the queries and helplessly committed that all these will be answered and copies of documents be tabled in another General Body to be held on 13.11.2011. But, even after issuing circular to the parents for the meeting, this General Body was postponed at the last minute without proper intimation to parents, greatly inconveniencing them. Later this postponed general body meeting was also cancelled, as announced in the PTA Executive meeting on 10.12.2011, mocking at the entire parents community of BMV. This was another humiliation, fooling and betrayal of parents, making them totally helpless. Similarly, written request of 72 parents for convening general body meeting to discuss fee hike issue in May 2011 was also not honored by SM.
8.   Even the incomplete balance sheet of AY 2010-11 provided by the school through RTI shows huge manipulation of accounts, to show an artificial deficit and exploit the parents. There was no deficit in reality as such no need for fee hike for the years 2011-12. Some of the points observed during the first look at the incomplete balance sheet of 2010-11 and Estimated income & expenditure statement for the year 2010-11 are as below for your reference:
      a)  The PTR of the school has been grossly manipulated  and on this front alone the school seems to have embezzled in excess of one crore during the year 2011-12 alone. For AY 2010-11, the school showed Rs. 17,47,770/=  for salary of casual  teachers. This would mean that in addition to the already shown strength of 91 regular teachers, another around ten casual teachers were available. This would make the PTR, around 22.5:1 for around 2250 students. But in reality, on an average there has been  more than 40 students in each class during last several years. This huge difference needs thorough investigation.
      b)  As on 31.3.2010, there was a Devpt. Fund corpus of Rs. 2,31,86,685/-. Another collection of Devt. Fund of Rs. 48, 66,122/- was made during the AY 2010-11, making the total Rs.2,80,52,807/-. The interest on this should have been   more than Rs. 22 lacs whereas only Rs. 8 lacs has been shown in the account.  The whole interest received on unutilized Dev. Fund should have been used for paying arrears to the teachers, as per DOE Guidelines dated 16.4.2010, rather than resorting to fee hike.
c)           Even as per the BMV Accounts, since an amount of Rs.2,88,55,207 was available in the Devt. Fund as on 31-3-2011 and no development fund was utilized during AY 2010-11, there was no need to collect development fund in AY 2011-12. Therefore the amount collected is liable to be returned with interest.

d)    Since Bharatiya Vidya Bhavan (BVB), being a charitable trust/Society is supposed to run BMV on no-loss no profit basis, Bhavan’s Delhi Kendra should have contributed to the school fund an amount of Rs.27,71,740/-  on account of EWS  and about Rs. 4.5 lacs on a/c of BPL free ship (Total Rs 32.2 lacs). But, not even single penny was given, resulting in that much exploitation of parents. By doing so the fee paying parents have been denied the principle of natural justice. This is despite the fact that BVB is running many diploma / degree / PG courses from the same compound /complex and probably using the infrastructure and resources of BMV in many cases. 

d)          Expenditure on computer repairs, printing & stationery  and exam charges
        shown are very much on higher side

       e)  The old school van having  book value Rs.4, 89, 650/-  and old computers of book value Rs.40, 14, 001/- were disposed off details of which is matter of thorough investigation.

       f)       There appears to be huge embezzlement of funds in the purchase and  repairs of the computers. This needs to be investigated as Development fund collected from parents is being utilized for purchase of computers.

        g)  An amount of Rs.19, 32, 256/- has been shown to have been paid to wards administrative charges to Headquarters in AY 2010-11, which seem to be  diversion of parents money to elsewhere and needs to be investigated.

h)     An expenditure of Rs. 18, 24, 963/-  is shown  on repair & maintenance during AY 2008-09, Rs. 17, 85, 128/- were spent on repair & mtnc. during AY 2009-10 , and Rs. 10, 59, 002/-  were spent on repair & mtnc. in AY 2010-11. This huge expenditure is also a matter of thorough investigation.

         i) the huge deficit incurred in running the special education Department every year has to be born by BMV and cannot be transferred to the general parents as it is BVB’s responsibility as a charitable trust and as committed to DOE while obtaining recognition of BMV.

j)       About Rs. 3 Lac expenditure on traveling. Conveyance & vehicle running expenses during AY 2010-11cannot be justified.

        k)  Expenditure on renovation building/ground improvement during last three years is also seem to be on higher side.

9. LISTS OF COMPLAINTS ON WHICH DOE FAILED TO ACT SO FAR (Copies attached)
1.     On fee hike for the AY 2010-11 by Mrs. Sunita Joshi dated 12.4.2010, Annex.-1
2.     A comprehensive complaint on a number of issues including fee hike from Office bearers of PTA dated 25.11.10, Annex.-2
3.     Unanimous objection from all the parent’s representatives in PTA against current fee hike of 30 %  with copy to DOE dated 10.3.2011, Annex.-3
4.     Again a comprehensive complaint from PTA Executive member Sh. Mohan Gopalan  and another from PTA office bearers,  both dated 25.4.2011, Annex.-4
5.     A complaint from a parent Sh. Pramod Pathrave on PTA manipulations and other issues dated 25-4-11, Annex.-5
6.     A complaint by 71 parents to SM dated 2-5-11 following unilateral imposition of unprecedented 30 % fee hike by the SM, to immediately call PTA general Body with copy to DOE to intervene. This General Body was not called, Annex.-6
7.     A complaint addressed to DOE dated 2-5-11 by 89 parents against the unfair and illegal 30 % fee hike by SM, Annex.-7
10.       In view of the above, it is once again requested that your good office may look into various complaints, including this and detailed above brought to your notice during the last two years by the aggrieved parents individually and collectively. Your office, being the controlling authority of BMV is therefore requested to:
a)  Order an inquiry immediately to check and verify whether the unprecedented fee increase of 30 % was justified or not.
b)  To inquire whether BVB, in violation of the terms and conditions of allotment of Govt. land, has misused it for other commercial activities, including for opening a Management College and running scores of vocational courses on commercial lines.
c) Whether the school has been imparting perverted education, undermining NCF, National Educational Policy, and completing the NCERT Curriculum ?
d) Whether the SA has allowed the PTA to function unhindered and any or all DOE Guidelines have been flouted in election and function of PTA?
d)  Whether the returns submitted to DOE during the last ten years were correct or manipulated targeting exploitation of parents?
e)    whether the SM has been diverting the school fund to other heads?
f)    whether the SM has been utilizing the Development Fund for  purposes other than intended for?
g)   find out the extent of tacit support received from DOE for all these unfair and  illegal activities of BMV, fix responsibility and suggest/recommend action for dereliction of duties under relevant service rules.








ANNEXURE "B" :   Complaint dated 12-3-2012 to DOE








                  
 dated 25.11.2010 had emboldened the SM to increase fee by an unprecedented 30 % during 2011-12, over ruling the unanimous objections of PTA Parent’s body. There was more than 74 % increase in tuition fee by BMV in last 3 years. Further, DOE’s circulars dated 11.2.2009 and 16.4.2010 regarding fee collection from parents have been flouted with impunity. This is happening despite DOE has full authority to regulate fee, as asserted by Shri. K.S. Yadav, DDE(West) in case No. WP (C) 2169/2011 and endorsed by the Hon’ble Delhi High Court. Again, this time also, regrettably, we have received no communication from DOE regarding the action taken on our complaint dated 18-1-2012 to date.

2.     It is pertinent to mention that the apparent absence of any regulating agency due to inaction by DOE has resulted in unbridled corruption and brutal exploitation of parents by BMV. It has been noticed that the SM was always showing highly exaggerated expenditure and less income, as detailed below, targeting for an artificial deficit and then increase fee. Again, the SMC in its meeting dated 03.2.2012 decided to increase fee by another 10 % during the year 2012-13, citing a deficit of Rs. 45.71 lakhs. Astonishingly, this is despite PTA representatives had delineated in the SMC Meeting a number  of manipulations in the Income and expenditure Estimate for 2012-13.


3.    In this backdrop, your kind attention is invited to the following manipulations by BMV in the Estimated accounts for year 2012-13 (copy enclosed).
I. Expenditure
a)   An amount of Rs.18,58,770/= has been estimated to pay to Bhavan’s Head Office as service charges. This is diversion of parent’s hard earned money elsewhere and hence illegal.
b)  Electricity charges has been estimated to Rs. 11 lakhs against the actual of Rs. 3.52 lakhs in 2010-11(at least 6 lakhs is apparently shown more). This matter needs thorough investigation in view of the fact that the same school infrastructure is being used by Bhavan’s Delhi Kendra to run so many vocational courses after school time and holidays.
c)    A deficit of Rs. 19.17 lakhs has been shown to have transferred to the School Fund as expenditure on account of Special Education Department deficit. This must be borne by Bhavan’s Delhi Kendra as a charitable trust and cannot be enforced on the other parents. Ironically, Bhavan’s Delhi Kendra, itself spending nothing, is imposing the entire financial implication on parents and is claiming the entire credit of running the Special Education Department for the less fortunate ones in the Society.
d)  Rent, rates and Taxes expenditure have jumped almost ten times, from Rs. 2.6 lakhs in 2010-11 to 23.7 lakhs in 2012-13, citing NDMC increases. This is a highly exaggerated figure and needs to be investigated. (seemingly it would be around 4-5 lac, a difference Rs. around Rs.19 lac )
The aggregate of these four grossly exaggerated expenditure is around Rs. 62.5 lakhs.
II. Income  
a)  The interest on FDR in the estimate for 2012-13 is  shown only 7.5 lakhs, whereas  it should have been around RS. 22 lakhs, given the fact that the FDR is  Rs. 2,50,63,921/=, as per the balance sheet for 2010-11.(Difference Rs. 14.5 lakhs)
b)  Similarly, the interest on Development Fund reserve is shown as only Rs. 9 lakhs. It should have been around Rs. 38  lakhs given the fact that there is a huge amount of un-utilized Development Fund of Rs.4,23,67,774/= , as per balance sheet for 2010-11 and revised estimate for 2011-12. (Difference Rs. 29 Lac )
c) As per Balance sheet for 2010-11, there was a financial   implication of Rs. 32 lakhs on account of EWS student’s fee. According to Revised Estimate for 2011-12, another 6 lakhs would be needed, making the total Rs. 38 lac . Since this is a Constitutional commitment of Bhavan’s Delhi Kendra on account of running a school, it should bear this amount and cannot be charged from other parents, as specified by DOE time and again.
The aggregate of such incomes shown less would be around Rs. 75.5  Lac.       
4.                This would mean that there is a manipulation of about Rs. 1.38 Crore in the estimate. This would further mean that instead of deficit, there is a surplus of Rs.92.3  Lac during the year 2012-13 and hence no fee hike is required; instead, there should be at least 20 % reduction in T. fee as Bhavan is committed to run  the school on no loss-no profit basis. Further, since as per DSE 1973 and DOE instructions, Devt. Fee is not necessarily to be charged, particularly when there is a huge un-utilized Devpt. Fund reserve (Rs. 4,23,67,774/=) available, out of which only Rs.73 lac is estimated to be utilized, as per estimate for 2012-13.

5.                Further, Rs. 15 Lac have been estimated to spend on        repairs and maintenance in 2012-13,  which are very         much on the higher side and need thorough investigation given the fact that there was an expenditure of about Rs. 60 Lac during last four years on the same head.

COMMENT ON 10th FEBRUARY 2012 MINUTES


Refer minutes of 10th February PTA Executive meeting Minutes. Which member/members raised the question of replacement of Vice Chairperson and Secretary and on what ground ?. Why the minutes is silent on this  aspect? What is the interest of this/these   members in replacing office bearers from parents side. Who will be the ultimate beneficiary of this move ? . Parent’s attention is invited to PV update dated 19.10.2011 about first ever election of  PTA office bearers from parents side un-interfered by the School Management.
Information obtained through RTI reveals that the School Transport fund has 50 to 60 lacs surplus.  Let us wait and see What happens on this front ?

WHY SUB COMMITTEE?

It is learnt that Principal, despite strong objections raised by PTA vice chairman, secretary and a member, went ahead with the proposed 11th January PTA executive meeting and   decided on the four issues of subcommittee formation, uniform, transport and sponsorship for needy children. Subsequently on the 28th  January 2012 PTA executive meeting which was held on a holiday, with sufficient notice and detailed discussions, with all concerned, these issues were further discussed in detail. (Please see minutes below).

WHY COMMITTEE FOR SPONSORSHIP FOR NEEDY CHILDREN? 

Parents may recall that AGM dated 16th October 2011 had decided to do away with PTA subcommittees and co-option to PTA on strong grounds. Now again, School Administration imposed these things on the parents. Parents also may recall  the questions raised in the 16th AGM meeting about diversion of PTA funds. It is now confirmed  that owing to pressure from parents, an amount of Rs 2,29,060/= was credited back to PTA account on 28.11.2011, making the total in PTA account to around Rs. 4.5 lacs. Reportedly, some PTA parents representatives whose selective meeting was held by the principal on 6th January 2012, are keeping their own lists of "smart" parents who want to avail 50% fee reduction from the PTA fund under the garb of "needy children". These parents have already reportedly made dealings (under what ?), with a few of the above Parents representatives, with the strong support of the School Administration, who seem to ultimately benefits out of all these murky deals.According to one of the Parent's representatives, the above PTA fund is to be exhausted by 31st March 2012.. This would mean that about 23 parents would benefit from it.
